It is somewhat hard to predict how the US Court may rule in this
instant case. This is different than the Florida case in 2000.
In the 2000 Florida case the Florida Supreme Court ruling was
contrary to Florida election law, something the did not have the
power to overrule. In that case the US Supreme Court, in a seven
to two vote, ruled that ONLY the Florida Legislator could make
election law, and by a five to four vote stopped the partial
recount because it was not allowed by Florida law.
In the California case the question is disenfranchising of some
voters. Albeit those that are to dumb to read they must REMOVE
the 'chad.' Since even in a delayed election they may still be
using the same equipment is a weak argument it seems.
