chrysler-dodge contract
2001 grand dodge caravan warning a lot of deals outsource there extented
warrenty to encore the company has gone bankrupt therfore the dealer is
telling me i no longer have a contract. Chrysler indicates since it wasnt
there contract they cant help me. the dealer is avoiding me.
If anyone has had this problem please let me know what you have done to
correct. I am ready to go to tv and expose my dealership.

I would believe that if you signed a contract through the dealership for an
extended warranty, you would be right in expecting the dealership or
Chrysler to honour the warranty. If they choose to outsource the contract to
a third party that would be there choice, but they would still be
responsible to honour the intention of the agreement. However if the
contract explicitly states it is with a third party and Chrysler or the
dealership is just acting as a sales agent then they would not be liable to
follow the terms of the agreement when the company went bankrupt.
Just an idea but irregardless talk to some one familiar with the legal
aspects of this in your area, a lawyer. They maybe able to resolve this with
less hassle than you alone.

Always buy the factory extended warranty, the dealer is not liable for
bankrupcy, I have seen this so many times, when a company goes under, I had
a 20 homebuyers warranty on the house i bought, That company went under as
well, im SOL cant hold the builder responsible

How is Chrysler responsible. They sell there own warranties. They are not
responsible for a third party company!

DODGE SOLD ME THE CONTRACT AND DIDNT TELL ME WHO IT WAS THRU. STUPID ME
NEVER EVEN ASK I ASSUMED IT WAS THEM. CAUSE THIS IS ON A 2 YR EXTENDED
WARRENTY AT THE TIME I PURCHASED THE CAR.

Dodge? Or the dealer? The dealers are independent retailers, Dodge is the
manufacturer. Dodge, Chrysler, Jeep manufacturer has there own contract.
They are not out of business?

I agree with dan c. BTW the dealer sold it and you signed for it. It likely
explained on the paper who does what. as the Buyer you must read (and
understand) before signing. an expensive life lesson unless you can fine
your paperwork and show fraud. Good luck.

I would still consult with an attorney nonetheless.
There's not going to be any charge to simply talk to him and describe
what happened to see if your situation is actionable.
That's the easiest/cheapest/most sensible thing to try first.
